Chapter # 13 & 14
Overview
The topic of Chapter 13 Is about Land Use Controls, in this chapter it goes over public restrictions, zoning, police power, building codes, subdivision laws and private restrictions. In Chapter 14 the topic is about Civil Rights and Fair Housing Laws. It talks about the historical background of the civil rights act, federal fair housing act, disability act, fair lending laws, and California legislation.
Key Concept from Chapter 13
I learned that most counties and cities have an independent planning commission and that smaller communities the city council often acts as the planning agency. The planning commission is responsible for preparing a comprehensive, long-term general plan for all development within the city or county (p. 470). The general plan outlines the community’s development policies and establishes an overall design for the various land uses in the area (p. 470).
Key Concept from Chapter 14
The second thing I learned is a little more about the history of the Civil Rights Act of 1866. The Civil Rights Act of 1866 is constitutional under the thirteenth amendment and prohibits discrimination based on race or ancestry in any property transaction in the United States (p. 497). The early civil rights were originally interpreted to only prohibit discrimination that involved state action.
Key Concept from Chapter 14
I learned more about the Federal Fair Housing Act, which was called title VIII of the Civil Rights Act of 1968. The act prohibits discrimination based on race, color, national origin, religion, sex, familial status, or handicap (disability) in the sale or lease of residential property (p. 499). It also prohibits discrimination in advertising, lending, brokerage, and other services in residential transactions (p. 499).
Summary
These two chapters gave me a better understanding of zoning laws, and zoning ordinances. I also learned that California has two laws that govern the subdivision of land in the state that are subdivision map act and subdivided lands law. It also explained prohibited acts like steering, blockbusting, and redlining. Blockbusting is when a realtor predicts that the entrance of minorities into a neighborhood will result in lower property values, higher crime rates or some other undesirable consequence.
