In 2008, two African-American men
attacked two Ecuadorian brothers on a street corner in Brooklyn, New York. One
of the assailants, Hakim Scott, chased down one of the brothers with a broken
beer bottle, while Keith Phoenix beat the other man to death with a baseball
bat. Scott was convicted of manslaughter and assault, whereas Phoenix was
convicted of murder and assault. Justice Patricia DiMango sentenced both men to
37 years to life in prison.

This case involved multiple special
populations. Both the offenders and victims were racial and ethnic minorities,
and the judge was a woman. If the case had not involved any or all of these
special populations, do you think the convictions and/or sentences might have
turned out differently?

For this Discussion, you explore
factors that may affect criminal justice outcomes for cases involving special
populations. Begin by selecting a recent news story covering a crime involving
a special population that resulted in a conviction. This news story may be from
the local or national news and should be no more than 5 years old.
